1. About this website

This website is operated by Michael Inglis Design.
References to “I”, “me” or “my” mean Michael Inglis Design.
References to “you” or “your” mean the person or business using this website or placing an order.

These terms apply to:

Print on demand products sold through the online shop

Design services

Website design and website maintenance services

Additional or more specific terms may apply to certain services, for example the Website Maintenance Plan. If that happens, those specific terms sit alongside these Terms and Conditions.

2. Using this website

You must be at least 18 years old or using the site with the permission of an adult.

You agree not to:

Use the site for any unlawful purpose

Try to gain unauthorised access to the site or server

Copy or reuse any content or designs from the site without permission

I may change or remove parts of the site, or suspend access, if I need to for security, maintenance or business reasons.

3. Orders and how the contract is formed

When you place an order through the online shop:

You add products or services to your basket and complete checkout.

You will see an on-screen confirmation and receive an email acknowledgement.

A contract is formed when I accept your order and payment is successfully processed.

I may decline or cancel an order, for example if:

There is a pricing or product error

The payment is not authorised

I am unable to fulfil the order for practical reasons

If I cancel an order after payment has been taken, I will refund you in full.

4. Prices and payment

All prices shown on the website are in pounds sterling (GBP) and include any applicable UK VAT, if charged.

You agree to pay the price shown at checkout for the products and services you select.

Payment is taken securely through my chosen payment provider (for example Stripe or PayPal). Your card details are processed by the payment provider and are not stored on this website.

I may update prices from time to time. The price you pay is the price shown at the time you place your order.

5. Print on demand products

Print on demand products are produced to order. This means items are created specifically for you once your order is placed.

Please check all details carefully before confirming your order, including:

Product type and size

Colours and finishes

Names, dates or any personalised text

Colours on screen may appear slightly different from the final printed product because of differences in screens, devices, inks and materials. Minor colour variation is normal and is not treated as a fault.

Estimated production and delivery times are shown at checkout. These are estimates only. Delays can sometimes happen that are outside my control, for example courier issues or supply problems.

You are responsible for providing the correct shipping address. If an incorrect address is provided and the order is lost or returned, any re-delivery costs may be charged to you.

6. Returns and refunds (print on demand)

Because print on demand products are made to order, there is no automatic right to change your mind and return them if you simply no longer want them.

However, you do have rights if something is faulty or damaged.

Please contact me as soon as possible if:

Your item arrives damaged

The wrong item is received

There is a clear manufacturing fault

I may ask for:

A brief description of the issue

Photos showing the fault or damage

Your order number

Where a product is confirmed to be faulty or damaged, I will either:

Arrange a replacement at no extra cost, or

Offer a refund, depending on what is reasonable in the circumstances

This does not affect your statutory rights under UK consumer law.

7. Design services and web services

Design services and web design or web maintenance services are usually delivered as a project or as an agreed plan.

Details such as scope of work, pricing, timelines, number of revisions and handover of files will normally be set out in:

A proposal

A statement of work

Or specific service terms, such as the Website Maintenance Plan Terms and Conditions

You are responsible for providing:

Clear and timely information, content and feedback

Any required access to systems, websites or hosting

Delays in providing information or access may delay delivery times.

Unless agreed otherwise in writing:

Deposits paid for design or web projects are non-refundable once work has started

Work completed up to the point of cancellation will be chargeable

I cannot guarantee specific results such as search engine rankings, visitor numbers or sales, as these depend on many factors outside my control.

8. Website Maintenance Plan

If you subscribe to a Website Maintenance Plan, the specific Website Maintenance Plan Terms and Conditions will apply in addition to this page.

If there is any conflict between the two, the Website Maintenance Plan Terms and Conditions will take priority for that plan.

9. Intellectual property and usage rights

Unless we agree otherwise in writing:

All original design work, layouts, code and artwork created by me remain my intellectual property until paid for in full

Once paid in full, you receive a licence to use the final supplied designs or website for your own business purposes

This licence does not normally include:

The right to resell or redistribute designs as templates or stock assets

The right to claim the work as your own creation

You are responsible for ensuring that any content, images or materials you provide:

Do not infringe the rights of others

Comply with any licences or permissions that may be required

If you supply images, fonts or copy that you do not have rights to use, you are responsible for any claims that arise.

10. Third-party services

Some products and services depend on third-party tools, such as:

Hosting providers

Print partners

Email services

Payment processors

Plugins or software from other companies

I am not responsible for failures or problems caused by third-party services, but I will act reasonably to help identify and resolve issues where possible.

11. Limitation of liability

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited under UK law.

To the fullest extent permitted by law:

I am not liable for indirect or consequential loss, including loss of profits, revenue, data or business

My total liability in respect of any claim in any 12-month period is limited to the total amount you have paid to me through this website in that same period

You remain responsible for your own backups, legal compliance and business decisions.

12. Changes to these Terms and Conditions

I may update these Terms and Conditions from time to time. Changes will be posted on this page with an updated date.

If you place an order after changes are posted, the updated terms will apply to that order.

13. Governing law

These Terms and Conditions are governed by the laws of Scotland.
Any disputes will be subject to the exclusive jurisdiction of the Scottish courts.
