Website Maintenance Plan – Terms & Conditions
These Terms & Conditions apply to the Website Maintenance Plan provided by Michael Inglis Design (“I”, “me”, “my”) to you as the website owner (“you”, “your”). By subscribing to the plan, you agree to these terms.
1. Plan overview
- Rolling 30-day subscription billed monthly in advance.
- No long-term contract – you can cancel any time, and the plan runs to the end of the current paid period.
- The plan is designed to keep your WordPress site secure, updated and working smoothly – it is not unlimited support or general IT support.
2. What’s included
Each 30-day period includes:
- Core technical maintenance
- WordPress core updates
- Theme updates
- Plugin updates
- Security updates and basic hardening
- Automatic backups and basic uptime monitoring (where supported by your hosting)
- Contact form email delivery maintenance
- Periodic checks that form submissions are delivered to your nominated email address.
- Fixing common delivery issues on the website side (form settings / mailer config).
- Up to 2 hours per month for:
- Website page content updates and edits.
- Bug and error fixing on the website.
- Email delivery issues related to the website (e.g. form mail, SMTP plugin config).
Time is tracked in 15-minute blocks. Unused time does not roll over.
3. What’s not included
The plan does not include:
- Web hosting support or server administration.
- IT support for your devices (phones, tablets, computers, routers, etc.).
- Email issues with email providers or software such as Outlook, Apple Mail, Gmail, Microsoft 365, Google Workspace, ISPs, etc.
- Social media management or ongoing posting.
- SEO strategy, campaigns or ongoing SEO support.
- Marketing strategy, campaign planning or management.
- Brand management or brand strategy work.
- Design work on new UX or UI (full redesigns, new layouts, new design systems).
- Full website rebuilds or new website designs.
- Custom plugin development or complex custom coding.
- Any third-party costs (premium plugins, themes, external tools or services).
4. Extra work and chargeable tasks
Work outside the included 2 hours per month, or outside the scope above, is chargeable at £25 per hour, unless otherwise agreed in writing. This includes:
- Any additional changes, fixes or updates once the 2-hour allowance is used.
- Repairs required because of deliberate changes made without notifying me first, for example:
- Editing or adding custom code (PHP, JS, CSS, theme files).
- Activating, deactivating, installing or deleting plugins or themes.
- Direct changes to styling, branding assets or layouts in theme files.
- Uploading or removing files in a way that breaks layout or performance.
- Any file uploads, deletions or edits via FTP or file managers.
- Any third party (developer, agency, contractor, staff) accessing the site, hosting or database without informing me as website admin.
- Major changes or projects such as new functionality, new templates, restructures or redesigns – these are quoted as separate projects.
5. Your responsibilities
- Provide and maintain valid admin access to WordPress and, where needed, hosting or DNS.
- Inform me before giving access to any third-party developer or agency.
- Inform me promptly if you notice issues or suspect your site has been compromised.
- Avoid major technical changes (code, plugins, themes) without consulting me first, unless you accept that repair work will be chargeable.
You remain responsible for legal compliance (e.g. GDPR, cookies, policies), and for the accuracy and legality of all website content.
6. Fees, billing and cancellation
- Plan cost: £25 per month, billed monthly in advance.
- Payments are taken via my online payment system (WooCommerce/Stripe or similar).
- You can cancel any time; the plan continues until the end of the current paid period.
- No partial refunds are given for unused time.
7. Uptime, security and backups
- I take reasonable care to keep your website secure, updated and backed up.
- No system can be guaranteed to be 100% secure or always online.
- I am not responsible for outages or issues caused by third-party providers (hosting, networks, plugins, external services), but I will help investigate and mitigate where possible.
8. Liability
To the fullest extent permitted by law, I am not liable for indirect or consequential loss (including loss of profits, sales, data or business). My total liability in any 12-month period is limited to the total amount you have paid for the maintenance plan in that period.
9. Termination by me
I may terminate the plan with reasonable notice in cases such as repeated non-payment, repeated unadvised changes that cause instability, or breakdown of the working relationship. Where possible, at least 30 days’ notice will be given.
10. Changes to these terms
I may update these terms or the plan from time to time. If there is a material change (for example, price or scope), I will notify you in advance by email. You may cancel if you do not accept the new terms.
11. Governing law
These terms are governed by the laws of Scotland, and any disputes are subject to the exclusive jurisdiction of the Scottish courts.
